Overview And Experience
With over 13 years of legal excellence, Advocate Sumit Kumar, stands at the helm of Modi and Associates, which he founded in the year 2013.
Mr. Kumar, is a B.A. LL. B (Symbiosis Law School, Pune under the Symbiosis International University) and Diploma holder in IPR (UNO) and Cyber Law (GLC, Mumbai and Asian School of Cyber Law).
Mr. Kumar has successfully handled a wide spectrum of cases including civil, criminal, corporate, constitutional, environmental, labor, consumer, service, and real estate litigation.
Mr. Kumar is a go to lawyer in Delhi NCR for matter involving heinous Criminal Provisions such as Rape, POCSO, Murder, etc. Mr. Kumar has a win loss ratio of 28 to 2 in such cases. Further he has secured bail in such heinous offences in more than 100 cases.
Mr. Kumar is also a go to lawyer in Delhi NCR for matrimonial matters having achieved excellence in counselling of married couples having troubles in marriage and has saved about 40-50 marriages from break -down (divorce), through his human and realistic problem focused counselling sessions. Otherwise, Mr. Kumar also have secured divorce in about more than 100 cases for married couples having reached a point of “NO RETURN”/”TOXIC”.

FEW REPORTED DECISIONS: -
- Shabnam Burney Vs. Union of India; W.P (C) No. 8035/2014 (Yamuna Encroachment case): – Hon’ble Delhi High Court directed vide order dated 08.07.2024 for removal of all encroachment from the flood plains/river bank of the Yamuna River, impending its flow and casuing urban flood in Delhi and formed a committee under the Vice Chairman of DDA for the said Task.
- M/s Kalamani Tex & Anr. Vs. P. Balasubramanian; Crl. Appeal No. 123/2021:- Hon’ble Supreme court upheld the impugned order of the Hon’ble High Court court convicting the accused petitioner setting aisde the order of acquittal of the Ld. Trial court herein in the matter argued by the undersigned on behalf of the complainant respondent holding the admission with regards to the signature on the cheque as fulfilling the requirement of section 138 NI act to fasten liability of presumption under section 139 of the NI Act and thus putting the onus of proving defense on the accused.
- Rohitash Kumar Vs. The State of Bihar; Criminal Misc. No. 3774 of 2023: – The Hon’ble Patna High Court has granted anticipatory Bail in the matter of rape and false marriage to a BSF Constable.
- Master Sushrut Singh Vs. Sainik School Society and Ors; W.P. (C) No. 5910/2022: – Hon’ble Delhi High Court directed the Sainik School to grant admission to the student treating discrepancy of non-mention of caste particulars in accordance to the certificate submitted as minor and not of nature leading to cancellation of Admission.
- Indra Deo Sah Vs. State of Bihar; SLP (Crl) No. 1557 of 2022:- The undersigned has secured from the Hon’ble Supreme court bail in matter of section 307 IPC.
- Bindeshwar Sah Vs. State of Bihar and others; Crl. A. No. 003025/2024: – The Hon’ble Supreme court of India cancelled the bail granted to the accused in the matter under section 302 IPC. The undersigned has appeared for the petitioner/father of the victim, seeking cancellation of bail.
- P.M. Duraiswamy Vs. The Bar Council of India and Ors; W.P. (C) No. 1094 of 2018: – The Hon’ble Supreme court ordered staying the publication of result for the election to the Bar Council of Tamil Nadu until disposal of the Petitioner’s objection.
- Neha Mishra & Anr. Vs. The State of West Bengal; W. P (Crl) No. 364 of 2021: – The undersigned secured Anticipatory Bail directly under Article 32 Petition from the Hon’ble Supreme court of India for the offence of kidnapping and Rape.
- Rashtriya Rajdhani Kshetra Tipahiya Chalak Union Vs. UOI; W .P. (C) No. 11363/2022: – The undersigned has secured interim stay and subsequently final order for the petitioner’s association taxi and auto drivers from being evicted from the Anand Vihar Railway station premises on payment of modest monthly parking charges as opposed to per 15 minute charges of Rs. 50/- being imposed in the railway station for all other vehicles.
- Nyaybhoomi Vs. ANI Technologies Pvt. Ltd. :- The undersigned has secured registration of criminal case against Ola taxi CEO for non-compliance of Motor vehicle laws in the NCT of Delhi and further charging surge pricing.
- Nyaybhoomi Vs. Uber India Systems Pvt. Ltd.:- The undersigned has secured registration of criminal case against Uber taxi CEO for non-compliance of Motor vehicle laws in the NCT of Delhi and further charging surge pricing.
